Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Meetgen website, platform, and services (collectively, the “Service”). By accessing or using the Service, you (“You”, “User”) agree to be bound by these Terms. If You do not agree, You must not use the Service.

These Terms form a legally binding agreement between You and Meetgen, Wiltonstraat 29, 2722 NG Zoetermeer (“Company”, “We”, “Us”, “Our”).

1. Definitions

For purposes of these Terms:

  • Account: A unique account created by or for You to access the Service.
  • Content: Any text, images, data, media, or other materials uploaded, submitted, or displayed through the Service.
  • Customer Data: Data submitted to the Service by You or on Your behalf, including form submissions, ad data, funnel data, scheduling data, and any information processed through integrations.
  • Subscription: The paid plan You select (Starter, Performance, Agency, Enterprise, or custom).
  • Service: The Meetgen.com software platform, including funnels, forms, integrations, conversion tracking, and any related tools.

2. Eligibility

You must be at least 16 years old and legally able to enter into contracts to use the Service on behalf of Yourself or your business.

Accounts

You may be required to create an Account to use certain features of the Service. You are responsible for maintaining the security of Your Account and for all activities that occur under Your Account.

3. Account Registration & Security

  • You must provide accurate information when creating an Account.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity that occurs under your Account.
  • You must notify Us immediately of unauthorized access or suspected security issues.

We reserve the right to suspend or terminate Accounts that violate these Terms.

4. Use of the Service

You may use the Service solely for lawful business purposes and in accordance with these Terms.

You are responsible not to:

  • Use the Service for spam, misleading advertising, fraud, or unlawful marketing.
  • Use the Service to collect or process sensitive personal data (e.g., health, biometric, credit card numbers) unless You have obtained explicit consent and have lawful grounds.
  • Attempt to reverse engineer, decompile, or otherwise extract source code.
  • Interfere with or disrupt the Service or bypass rate limits or security measures.
  • Misrepresent or imply that Meetgen endorses your ads, funnels, or business.

You retain ownership of your Content and Customer Data. You grant Us the rights necessary to operate the Service (hosting, processing, displaying, transmitting, etc.).

5. Subscriptions, Billing & Payments

5.1 Billing

  • Subscriptions are billed in advance on a monthly or annual basis.
  • By subscribing, You authorize Us or Our payment provider to charge your provided payment method.

5.2 Auto-Renewal

Subscriptions automatically renew unless canceled before the end of the billing period.

5.3 Price Changes

We may adjust pricing upon notice. Changes apply at the next renewal unless otherwise stated for promotional or lifetime discounts.

5.4 Free Trials

Free trials may be offered at Our discretion. We may end a free trial at any time.

5.5 Refunds

Unless otherwise required by law, all payments are non-refundable, including for:

  • Partial months
  • Unused quotas
  • Early cancellation

6. Usage Limits

Each Subscription includes usage limits (e.g., form submissions, booked meetings, integrations, funnels).

If You exceed your limits, We may:

  • Charge overages,
  • Rate-limit your account,
  • Pause tracking, scheduling, or integrations, or
  • Require an upgrade.

We will make reasonable efforts to notify You before enforcing limits.

7. Availability & Performance

We strive to maintain high uptime and performance, but:

  • The Service is provided on an “as-is” and “as-available” basis.
  • We do not guarantee uninterrupted access, specific performance levels, or error-free operation.
  • We are not responsible for outages caused by third parties (e.g., Calendly, Meta, Google Ads, TikTok, Cloudflare, server outages).

8. Third-Party Services & Integrations

Meetgen integrates with platforms such as Calendly, Meta, Google, TikTok, and other tools via APIs or webhooks.

You acknowledge:

  • Integrations may change or break at any time.
  • We are not responsible for issues caused by third-party platforms, policy changes, or API limitations.
  • Your use of third-party services is governed by their own terms and privacy policies.
  • You are solely responsible for ensuring lawful use of third-party tracking and advertising tools.

9. Customer Data & Privacy

By using the Service, You grant Us the right to process Customer Data solely to provide and improve the Service.

We do not own Customer Data.

We follow applicable privacy laws including GDPR. Our Privacy Policy explains how We collect and use information.

10. Intellectual Property

The Service, including all software, code, UI, design, and documentation, is owned by Meetgen and protected by copyright, trademark, and other laws.

You may not copy, sell, sublicense, distribute, or create derivative works except as explicitly allowed.

11. Termination

We may suspend or terminate your Account immediately if You:

  • Breach these Terms,
  • Abuse the Service,
  • Violate laws or advertising platform rules,
  • Cause security or operational risks.

You may terminate at any time by canceling your Subscription.

Upon termination:

  • Your access to the Service may cease.
  • We may delete your data after a reasonable period, unless legally required to retain it.

12. Disclaimers

To the fullest extent permitted by law:

  • THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND.
  • WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
  • WE DO NOT GUARANTEE ANY PARTICULAR AD PERFORMANCE, CONVERSION RATE, BOOKING RATE, OR ROI.

You acknowledge that advertising outcomes depend on factors beyond Our control.

13. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, special, consequential, or punitive damages.
  • Our total liability for all claims related to the Service may not exceed the amount You paid in the 12 months prior to the claim.

We are not responsible for:

  • Loss of revenue, leads, meetings, ads, or profits,
  • Data loss, system failures, tracking errors, or downtime,
  • Third-party API failures or ad platform restrictions.

14. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its owners, employees, and partners from any claims or damages arising from:

  • Your use of the Service,
  • Violation of laws (including GDPR and advertising rules),
  • Inaccurate funnels, forms, or claims made in your ads,
  • Misuse of Customer Data,
  • Violations of these Terms.

15. Changes to These Terms

We may update these Terms at any time. Changes take effect when posted. If You continue to use the Service after changes, You agree to the updated Terms.

16. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes shall be resolved exclusively in the courts of the Netherlands.
